Officials with the local chapter of the American Civil Liberties Union accused county prosecutors and law enforcement of running a ?smear campaign? in their investigation into the shooting of Steve Foley. ACLU officials said information about Foley's past run-ins with police should not have been included in a search warrant affidavit filed in San Diego Superior Court on Thursday. They also said it was inappropriate for the investigator in the District Attorney's Office who wrote the affidavit to make a reference to ?roid rage,? a term used for uncontrollable outbursts and violence exhibited by some steroid users, according to the document. ?It is a catchy way to smear Mr. Foley,? said Kevin Keenan, executive director of the American Civil Liberties Union of San Diego and Imperial counties, during a news conference.
