A defense lawyer says Simms got charged with driving while high on marijuana because a police officer misunderstood Simms telling him a passenger had smoked the drug.
He was stopped at a police sobriety checkpoint July 1.
A prosecutor told jurors an officer found Simms slurring his speech, moving slowly and saying he'd smoked marijuana.
